Scope of this policy
This Privacy Policy applies to Dark Matt3r Studios, LLC ("Dark Matt3r Studios," "DMS," "we," "us," or "our") and covers this website, all games and applications we publish, our agentic and AI-assisted products, and the client engineering services we provide. It applies wherever this document is linked from, including inside shipped game and application builds distributed through Steam, the Apple App Store, Google Play, Meta Quest, and console platforms.
Product-Specific Supplements. Individual products
may add a supplement covering practices specific to that product,
such as additional data types collected in gameplay or
platform-specific disclosures. Where a product publishes a
supplement at a URL of the form /privacy/<product>,
that supplement controls to the extent it conflicts with this
general policy. Absent a supplement, this policy governs the
product in full.

What we collect
We collect the minimum amount of personal information reasonably needed to operate, secure, and improve our website, products, and client services. The table below summarizes the categories of information we process, examples of each, and where it comes from.

Why we collect it
We use the information described above to:
- Operate and deliver our website, games, applications, and agentic products;
- Diagnose, fix, and prevent crashes and errors;
- Understand whether features work as intended and where players or users encounter friction;
- Process purchases and manage entitlements;
- Send the devlog newsletter to subscribers;
- Respond to support requests and other correspondence; and
- Fulfill our contractual obligations to engineering services clients.
Legal bases (GDPR)
Where the General Data Protection Regulation ("GDPR") or the UK GDPR applies, we rely on the following legal bases under Article 6 for each purpose above:
- Contract — processing account, platform, and purchase identifiers, and client project data, is necessary to perform our contract with you or with a client.
- Legitimate interests — processing crash reports, gameplay telemetry, and multiplayer session data supports the legitimate interest of keeping products secure, functional, and improving over time, balanced against your rights and interests.
- Consent — website analytics cookies and the devlog newsletter are processed only where you have given consent, which you may withdraw at any time.
- Legal obligation — purchase records are retained where necessary to comply with tax and accounting law.
- Legitimate interests — support correspondence is processed so that we can answer your question and keep a record of what was asked and how it was resolved.
- Contract, or legitimate interests — operating AI and agentic features, including transmitting the inputs you provide to a model provider, rests on our contract with you where the feature is the service you asked for, and otherwise on our legitimate interest in providing and improving that feature.
We do not sell your data
Dark Matt3r Studios, LLC is not a data broker and does not sell or share personal information as those terms are defined under the California Consumer Privacy Act or the California Delete Act. We maintain a direct relationship with the individuals whose data we process — our players, users, newsletter subscribers, and clients — and we do not disclose personal information to third parties in exchange for money or other valuable consideration.
We collect personal information only in the minimum amount reasonably needed to operate and improve our products and services, and we do not collect data speculatively for resale or unrelated secondary use.

Each service provider is bound by contract to process personal information only for the purposes we specify and to apply appropriate security measures.
How long we keep it
We retain personal information only as long as necessary for the purposes described in this policy:
- Website analytics data — 26 months from collection;
- Crash and error reports — 12 months from collection;
- Newsletter email addresses — until you unsubscribe;
- Purchase records — as required by applicable tax and accounting law; and
- Client project data — for the period specified in the applicable client contract.
International transfers
Our infrastructure is primarily hosted in the United States. Where we transfer personal information originating in the European Economic Area or the United Kingdom to the United States or another country without an adequacy decision, we rely on Standard Contractual Clauses, together with supplementary measures where appropriate, to ensure the transfer is lawful and the data remains protected.
Your rights
If the GDPR or UK GDPR applies to you, you have the right to access, correct, delete, or port your personal information, to object to or restrict certain processing, to withdraw consent at any time without affecting prior processing, and to lodge a complaint with your local data protection supervisory authority.
If the California Consumer Privacy Act ("CCPA")/CPRA applies to you, you have the right to know what personal information we collect, to request deletion, to correct inaccurate information, to limit use of sensitive personal information, to opt out of the sale or sharing of personal information — including sharing for cross-context behavioral advertising, neither of which we do, as stated above — and to be free from discrimination for exercising any of these rights — we will not deny you goods or services, charge you a different price, or provide a different level of service because you exercised a privacy right.

Children
Our services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, contact us at contact@darkmatt3rstudios.com to request deletion, and we will honor that request promptly.
Where an individual product is designated as child-directed, that product will carry a supplemental notice describing the additional protections applicable to it, including any additional consent and data-minimization measures. Absent such a designation and supplement, a product is intended for a general audience.
AI and agentic systems
Some of our products include AI-assisted or agentic features. When you use these features, relevant inputs — such as text you type, prompts, or contextual data the feature needs to function — may be transmitted to third-party AI model providers in order to generate a response.
- Inputs submitted to AI features are not used to train third-party providers' general-purpose models, except where we explicitly state otherwise for a specific feature or product.
- We apply human review practices to AI and agentic features where appropriate, to monitor quality and safety.
- Model providers may retain inputs and outputs for a limited period on their own systems, for example for abuse monitoring, as described in the applicable provider's own terms.
- We advise against submitting sensitive personal information (such as government identifiers, financial account details, or health information) into agentic or AI-assisted features.
Client and business services
When we perform client engineering work, we typically act as a processor, handling personal information solely on the client's instructions and for the purposes the client directs, rather than as an independent controller of that data. The client remains responsible for its own compliance obligations toward its end users. Platform-specific notes
Our products are distributed through several third-party platforms. Each platform's own privacy policy also applies to your use of that platform, in addition to this policy.
Steam / Valve
Purchases, entitlements, and certain multiplayer and social features on Steam are handled by Valve in accordance with Valve's own privacy policy.
Apple App Store
Our App Store listings include Apple's required privacy label disclosures. We do not track you across other companies' apps and websites for advertising purposes through Apple's App Tracking Transparency framework unless a specific product explicitly discloses otherwise and requests your permission.
Google Play
Our Google Play listings include the Data Safety disclosures required by Google, summarizing the categories of data collected and how they are used and shared.
Meta Quest
Products distributed on Meta Quest are also subject to Meta's platform privacy policy, including any data Meta collects directly through the headset and operating system.
Console platforms
Products distributed on console platforms are also subject to the relevant console manufacturer's privacy policy, including account, entitlement, and telemetry data those platforms handle directly.
Security
We use industry-standard encryption to protect personal information in transit, and access to systems containing personal information is limited to personnel and service providers who need it to do their jobs. We do not store payment card data — payment processing is handled entirely by the platform or payment processor involved in a transaction.
In the event of a data breach affecting personal information, we will notify affected individuals and applicable regulators without undue delay, and within 72 hours where required by law.
Changes to this policy
The version number and date at the top of this page indicate when it was last revised. We will announce material changes to this policy on our website. Your continued use of our website, games, applications, or services after a change takes effect constitutes acceptance of the revised policy.
